Celsius founder Alex Mashinsky seeks dismissal of FTC case
Alex Mashinsky, founder and former CEO of now-bankrupt crypto lender Celsius, is seeking to have the U.S. Federal Trade Commission (FTC) drop its case against him “in its entirety.”
In a court filing Monday, Mashinsky's lawyers argued that the allegations do not support a claim that he knowingly made a misstatement to "fraudulently obtain customer information from a financial institution."
Specifically, Mashinsky's legal team argued that the accusations do not meet the standards for a claim under the Gramm-Leach-Bliley Act. This 1999 law requires knowingly making false claims to collect customer information fraudulently from a financial institution.
The lawyers further argued that “in addition to the fact that Celsius is in bankruptcy and entered into a settlement agreement with the FTC…, the Complaint cannot substantiate a claim that Mashinsky ‘is violating’ or is ‘about to violate’ the law because Mashinsky resigned from his position as CEO of Celsius in September 27, 2023.”
Celsius was one of the largest crypto-lending platforms before it collapsed in 2022. The founder resigned as CEO in September of that year, and by the end of 2022, the U.S. Justice Department had indicted the former CEO on multiple charges of fraud.
Mashinsky has pleaded not guilty to several charges filed against him and is out on bail on a $40 million personal recognizance bond.

At Apple's Wonderlust event on Tuesday, the company announced the iPhone 15 and iPhone 15 Plus, featuring a USB-C port, the Dynamic Island, an improved 48MP main camera, and more.
Like last year, the iPhone 15 and iPhone 15 Plus sport 6.1-inch and 6.7-inch displays. The big change this year is that the notch is gone, replaced by the "Dynamic Island" that Apple first brought to the iPhone 14 Pro lineup last year.
Another big change to the display is that it's brighter than ever before — the peak brightness in sunlight reaches 2,000 nits, while HDR video playback goes up to 1,600 nits.
The iPhone 15 also has a new 48-megapixel main camera, a notable improvement from last year's 12-megapixel main camera. This means that it can do 2x zoom without having a dedicated telephoto camera.
As expected, the device is powered by the A16 bionic chip, which features a six-core GPU. The chip also delivers Ultra Wideband, which offers improved FindMy functionality — similar to the new Apple Watch Series 9.
The iPhone 15 is priced starting at $799 for a 128GB model, and the iPhone 15 Plus starts at $899 for a 128GB version. Pre-sales start on Friday, September 15, and they'll be available in stores on September 22.
Google has announced the launch of the Digital Futures Project, an initiative that aims to study responsible artificial intelligence (AI) technologies.
The company will invest a total of $20 million in grants to leading think tanks and academic institutions around the world with the goal of facilitating "dialogue and inquiry” into AI technologies.
According to a blog post, Google hopes to address issues of fairness, bias, misinformation, security, and the future of work through deep collaboration with outside organizations.
“Through this project, we’ll support researchers, organize convenings, and foster debate on public policy solutions to encourage the responsible development of AI," Google's Director of Product Impact Brigitte Gosselink wrote.
Awardees who’ve already received grants under the fund include the Aspen Institute, the Brookings Institution, the Carnegie Endowment for International Peace, the Center for a New American Security, the Center for Strategic and International Studies, the Institute for Security and Technology, Leadership Conference Education Fund, MIT Work of the Future, R Street Institute and SeedAI.
The project’s launch comes as the CEOs of some of the largest technology corporations are set to convene in Washington, D.C., later today for an “AI Forum” hosted by U.S. Senate Majority Leader Chuck Schumer.
